Dans les couloirs de cette Facult\u00e9 transsyst\u00e9mique flottent des mots disparates\u00a0\u2014\u00a0<em>governance,<\/em> patrimoine, <em>consideration<\/em>, victime, <em>jurisdiction<\/em>, int\u00e9r\u00eats\u00a0\u2014\u00a0dont les sens et les connotations varient non seulement d\u2019une tradition juridique \u00e0 l\u2019autre, d\u2019une langue \u00e0 l\u2019autre, mais \u00e9galement d\u2019un juriste \u00e0 l\u2019autre. Au quotidien, l\u2019\u00e9vidence de cette pluralit\u00e9 est frappante. Pourtant, d\u00e8s qu\u2019on essaie de la capturer, elle semble se volatiliser.<\/p>\n<p>Our endeavour was to answer this inertia and find a project that would render this plurality a tangible reality. And so it was, on 20 December 2011, a group of scholars came together in the Paul-Andr\u00e9 Cr\u00e9peau Centre for Private and Comparative Law to discuss a series of short essays that had been written in the preceding weeks.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> \u201cLand,\u201d \u201c<em>contrat relationnel<\/em>,\u201d \u201ccustom,\u201d \u201cfiliation,\u201d \u201c<em>nom<\/em>,\u201d \u201csecurity,\u201d \u201cunjust enrichment,\u201d and \u201cvalues\u201d were the titles of these texts.<\/p>\n<p>By then, transsystemic teaching had been a fact<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> of daily life at McGill\u2019s Faculty of Law for over a decade. One ambition at the inception of the transsystemic program in 1999 was that professors would publish collaboratively written teaching materials to share with other scholars the Faculty\u2019s pioneering approach to teaching and thinking about law. That ambition was never fulfilled. Visions of the enterprise were individual and variable, and as always at McGill, different professors taught the same course each in their own fashion. Moreover, the conditions under which the program had come into existence\u2014in a bilingual and bijural faculty\u2014were very particular. It was not easy to see how teaching materials usable at McGill could be of use in other places. There was, however, an explosion of literature inspired by, and about, the transsystemic program, most but not all of it written by members of the Faculty.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>But the idea of a collaborative project that aimed to show what was special about the transsystemic program did not go away. Both of us were at the Centre in 2011, and it was the Centre that had been asked to coordinate a publication project that would showcase the transsystemic program. The Centre has, since its creation in 1975, produced bilingual dictionaries of Quebec private law, in which both of us had participated and still do; and one of us had recently contributed to <em>The New Oxford Companion to Law<\/em>,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> an alphabetically organized collection of short essays on a wide range of topics. And so, quite naturally, the idea was born of a <em>McGill Companion to Law: <\/em>short, individually-authored essays that would permit a reflection, from the perspective of transsystemic teaching and thinking, on some idea, concept, figure, thing. It would be a collaborative encyclopaedic dictionary of transsystemic legal thought, conceived as a way to reflect upon how the transsystemic program changed our way of thinking about law.<\/p>\n<p>Bien que le projet s\u2019appuyait sur la longue exp\u00e9rience du Centre en mati\u00e8re de terminologie et de dictionnaires juridiques, il ne s\u2019agissait ni d\u2019un dictionnaire ni d\u2019une encyclop\u00e9die qu\u2019un lecteur pourrait consulter pour obtenir des informations sp\u00e9cifiques sur un syst\u00e8me juridique. Notre projet avait plut\u00f4t \u00e9t\u00e9 con\u00e7u pour refl\u00e9ter la diversit\u00e9 et les mani\u00e8res d\u2019\u00eatre de chacun, chacune. Une br\u00e8ve liste de r\u00e9f\u00e9rences \u00e9tait facultative. Les notes de bas de page \u00e9taient interdites. Les contributeurs et contributrices n\u2019avaient droit qu\u2019\u00e0 1 500\u20132 000 mots chacun et chacune. Les personnes invit\u00e9es \u00e0 participer devaient aussi garder en t\u00eate quelques questions directrices\u00a0: comment votre compr\u00e9hension du droit a-t-elle \u00e9t\u00e9 modifi\u00e9e par la fa\u00e7on dont le droit est enseign\u00e9 \u00e0 McGill? Comment l\u2019exp\u00e9rience collective de la facult\u00e9 peut-elle \u00eatre utile \u00e0 d\u2019autres juristes, qu\u2019ils ou elles soient ou non en mesure de mettre en \u0153uvre un programme d\u2019enseignement juridique bijuridique et bilingue? Qu\u2019a-t-on appris, dans le cadre de ce programme, qui puisse \u00eatre utile \u00e0 d\u2019autres?<\/p>\n<p>The idea was always that the project would grow organically. There was no direction from the editors regarding the subjects of the entries. On the contrary, they reflect the idiosyncrasies of their authors, and the plurality of their approaches to law. The editors had imagined that there would even be more than one entry with the same title. Each draft entry was first reviewed by the editors, the present authors, with comments sent to the author. The revised entry was then circulated among the participants in the project: those who had written entries, and those who had expressed interest in writing in the future. Most participants were professors in the Faculty, although some were colleagues from other universities who had taught in the transsystemic program. A group of entries was then discussed and debated at a meeting of the project, sometimes including invitees whom the editors knew had research interests related to the entries in question. Following further revisions by the authors, the entries were published on a dedicated website. In this way, over the next five years, the project grew until twenty-eight entries had been approved. At that time, the project unfortunately had to come to an end.<\/p>\n<p>Pourtant, la richesse de ces textes et de leur assemblage ne pouvait rester sous silence. Leur publication \u00e9tait n\u00e9cessaire\u00a0: elle permettait de mettre un terme \u00e0 notre entreprise tout en conservant \u00e0 jamais ce projet d\u2019<em>\u00e9criture doctrinale<\/em><a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>. \u00c9videmment, tout comme la <em>propri\u00e9t\u00e9 <\/em>moderne, le projet \u00e9tait imparfait<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>, mais sa pluralit\u00e9 et sa diversit\u00e9 avaient \u00e0 elles seules une valeur et une port\u00e9e\u00a0: rassembler dans une m\u00eame \u0153uvre et autour d\u2019une m\u00eame table des juristes d\u2019horizons diff\u00e9rents (quant \u00e0 leurs expertises, leurs perspectives), qui, malgr\u00e9 leur proximit\u00e9 physique et leur aventure commune (l\u2019enseignement transsyst\u00e9mique \u00e0 McGill), n\u2019avaient pas la chance de se lire et de se commenter. La forme br\u00e8ve, authentifi\u00e9e et dat\u00e9e des textes permettait ce dialogue n\u00e9cessaire et participait \u00e0 la coll\u00e9gialit\u00e9 de la facult\u00e9. D\u2019une certaine mani\u00e8re, assister aux r\u00e9unions \u00e9tait comme participer \u00e0 un moment transsyst\u00e9mique\u00a0\u00ab\u00a0<em>on steroids<\/em>\u00a0\u00bb<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>!<\/p>\n<p>Le transsyt\u00e9misme a son propre chronotope. Comme la coutume<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>, il nous habite sans que nous puissions r\u00e9ellement le d\u00e9finir. Comme le souligne le Professeur David Lametti au sujet de la <em>destination<\/em><a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a>, le transyst\u00e9misme est mis en \u0153uvre sans que nous sachions exactement de quoi il s\u2019agit. Bien qu\u2019ind\u00e9finissable, un constat demeure\u00a0: c\u2019est un lieu de dialogue, de friction, de tension. Comme l\u2019iconographie de la <em>justice aveugle<\/em><a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a>, rien n\u2019y est net et simple, c\u2019est un lieu de questions plut\u00f4t que de r\u00e9ponse, un lieu qui nous rappelle notre propre responsabilit\u00e9<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> dans la construction d\u2019un monde que nous croyons plus juste.<\/p>\n<p>The Faculty has evolved. Its unique focus on transsystemic teaching has given way to a preoccupation with the language of transnational law, better-known and perhaps easier to explain to colleagues from other places.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> The endeavour of publishing the <em>Companion <\/em>in a permanent form aims to preserve a record of an extraordinary period in the life of the Faculty.
